Shortly before his death, William A. Urbanski ("decedent") revised his estate plan so that many of his assets were placed into a newly created revocable trust. His sons, defendants-appellants William G. Urbanski and Jordan S. Urbanski, were named as the beneficiaries of the bulk of the property in the trust. Decedents daughter, plaintiff-appellee Monica Holzemer, was also a beneficiary of the trust, but was not named as a beneficiary of most of the property that made up the trust corpus.
